Trader Joe’s is suing Joe’s Wines Co. in New York. The grocery chain argues that the new wine store is infringing on its brand by using a name too similar, claiming customer confusion. Trader Joe’s previously operated a wine shop nearby that closed in 2022.
Trader Joe’s demands that Joe’s Wines Co. change its name and pay damages. The lawsuit consists of 31 pages outlining these claims.
Joe’s Wines Co. defends its name, stating that "Joseph" is a family name rooted in winemaking history. The company argues that many businesses in New York use "Joe" in their names, including Joe’s Pizza, located close by.
The lawsuit also addresses the aesthetics of Joe’s Wines Co. Trader Joe’s says the new store mimics its look, citing similarities in logo, color scheme, and design. Trader Joe’s claims that Joe’s Wines Co. is causing consumer confusion, as locals initially thought the shop was affiliated with Trader Joe’s.
Joe’s Wines Co. has expressed frustration over the lawsuit. Joseph Strich, a spokesperson for the store, stated that the legal action is an unexpected challenge for a new business. They argue that Trader Joe’s closed its wine shop to hinder a unionization effort.
The wine store’s attorney, Alfred Zaher, insists that the similarities with Trader Joe’s name and branding are minimal. Zaher argues that "Trader" is the more dominant part of Trader Joe’s name, and many people refer to the chain simply as "Trader Joe’s."
Trader Joe’s claims it attempted to resolve the issue outside of court. The small business had indicated it would alter its branding but has not fully complied, leading to the current legal action.
Trader Joe’s is seeking a name change for Joe’s Wines Co., as well as damages, attorney fees, and punitive damages.
