Essayli, appointed by Attorney General Pam bondi, previously defended January 6 defendants, arguing thay were exercising First Amendment rights. Now, he takes a firm stance against protesters opposing deportation efforts.

Essayli, a Republican state assembly member elected in 2022, quickly ascended to the Justice Department post.Despite a limited legislative record, he gained prominence in conservative circles by championing controversial bills and defending them on Fox News.
Critics argue that Essayli’s actions as U.S. attorney demonstrate a partisan agenda. He has pursued conspiracy charges against demonstrators protesting deportation policies, while asserting his support for peaceful protest.
With Essayli’s temporary appointment set to expire at the end of July, activists are urging California’s U.S. senators to block his potential permanent nomination. They cite the ”blue slip” process,which allows home-state senators to effectively veto U.S. attorney nominees.
Jacob Daruvala, director of the Stop Essayli campaign, said, “This tradition was made for exactly these kinds of things, where an attorney is just not acceptable as an appointee.He’s not ther for justice but for partisan purposes.”
essayli’s office did not respond to requests for comment.
Steep Charges
Essayli was sworn in on April 2, allowing him to serve for 120 days. He previously worked on the prosecution of the 2015 San Bernardino mass shooting as an assistant U.S. attorney.
As his appointment, Essayli has faced backlash from career prosecutors, protesters, and politicians.One of his first actions was to approve a plea deal for a sheriff’s deputy convicted of excessive force. This led to several federal prosecutors resigning, according to the Los Angeles Times.
As protests against ICE raids intensified, Essayli defended the administration’s response. He stated that the administration had “no choice” but to send in the National Guard, claiming law enforcement was overwhelmed.
His office also charged union leader David Huerta with a crime carrying a six-year maximum sentence for confronting federal agents. This action galvanized state Democrats, including U.S. Sen. Alex Padilla, who was briefly detained after questioning Secretary of Homeland Security Kristi Noem. Essayli accused Padilla of staging a “stunt” during the incident.
“He’s a vrey large person,” Essayli told Fox 11. “He’s very tall, he’s got a big demeanor. And he started charging, pushing his way through the security, shouting. We didn’t know he was here. We didn’t know who he was at the time. And then he started shouting, and then he was dragged out.”

Rare Power for Senate Democrats
under Senate tradition, home-state senators can effectively veto U.S. attorney nominees. Carl Tobias, a law professor, said Essayli’s nomination hinges on convincing Sens. Alex Padilla and Adam Schiff.
“If either senator says no from California, it’s over for this nominee. That may be the hardest obstacle,” Tobias said. “That’s what the White House has to work with: Padilla.”
Padilla, Schiff, and the White House did not comment on the matter.
LGBTQ+ activists are among those urging Padilla and Schiff to block Essayli’s confirmation.
Daruvala said he was motivated by Essayli’s position on trans kids’ rights and believes Essayli received the interim appointment to provoke state Democrats.
“I think Donald Trump was trying to choose the most anti-California person he could, and that was Bill Essayli,” he said.
