The Trump administration is seeking Supreme Court intervention to proceed with its plan to deport a group of migrants to South Sudan, a country plagued by conflict. This move comes despite a federal judge’s order that blocked the deportations, citing concerns about due process and the migrants’ opportunity to express fears of persecution.
The Justice Department, under Trump, has filed an emergency brief with the Supreme Court, bypassing the U.S. Court of Appeals. The administration argues that the judge’s orders are causing “irreparable injury” in diplomatic and foreign policy spheres. Solicitor General John Sauer contends that the court’s actions have forced the government to detain the migrants at a military base in Djibouti,creating a burden on American foreign policy.
Though, Judge Brian Murphy, who issued the initial order, stated that the decision to hold the migrants in Djibouti was at the discretion of the Department of Homeland Security (DHS). He emphasized that his order aimed to ensure the migrants had a “meaningful opportunity” to demonstrate fears of persecution, torture, or death if deported.
The legal battle centers on whether the Trump administration can expedite deportations to perilous countries without providing adequate due process. The administration has faced previous setbacks in similar deportation attempts.
Flight tracking data indicates that a plane carrying the migrants departed from Texas and stopped in Ireland before arriving in Djibouti.Judge Murphy convened emergency hearings after lawyers for the migrants reported they were given less than 24 hours’ notice of their deportation to South Sudan.

As Judge Murphy himself repeatedly emphasized, it was the DOJ that requested the option of holding them overseas!”
