The Tobacco and Vapes Bill has completed its passage through the UK Parliament and will become law next week following royal assent, marking a significant step toward creating a smoke-free generation.

Under the legislation, anyone born on or after 1 January 2009 will never be legally sold tobacco products in the United Kingdom, as the bill gradually raises the legal smoking age by one year each year starting from January 1, 2027.

This approach means that children who do not turn 18 before January 1, 2027 will be permanently prohibited from purchasing cigarettes or tobacco products, with the goal of preventing a lifetime of addiction and reducing the substantial health burden associated with smoking.

Smoking leads to 400,000 hospital admissions and 64,000 deaths annually in England alone, according to data cited in parliamentary discussions, and costs the NHS approximately £3 billion each year in treatments for tobacco-related illnesses such as cancer and heart disease.

The total societal cost of smoking in England is estimated to range between £21.3 billion and £27.6 billion per year, primarily driven by lost productivity, further underscoring the economic rationale behind the public health measure.

Health Secretary Wes Streeting described the bill’s completion as “a historic moment for the nation’s health,” emphasizing that children in the UK will be part of the first smoke-free generation, protected from lifelong addiction and harm.

He added that prevention is better than cure, and that the reform will save lives, ease pressure on the NHS, and contribute to building a healthier Britain.

The Tobacco and Vapes Bill also includes provisions to strengthen existing bans on smoking in public places, particularly to reduce the harms of passive smoking for children and vulnerable people in certain outdoor settings.

the legislation will ban the deliberate branding, promotion, and advertising of vapes and nicotine products to children, aiming to prevent the next generation from becoming hooked on nicotine.

To support enforcement, the bill provides powers to introduce a licensing scheme for the retail sale of tobacco, vapes, and nicotine products in England, Wales, and Northern Ireland, while expanding the retailer registration scheme in Scotland.

The government will also be empowered to impose a new registration system for smoking and vaping products entering the country, with the goal of improving oversight and strengthening enforcement activity.

Retailers who sell tobacco products to individuals not entitled to purchase them under the new rules will face financial penalties.

The rules apply across all four constituent countries of the United Kingdom — England, Scotland, Wales, and Northern Ireland — and were developed in conjunction with the devolved administrations in Belfast, Cardiff, and Edinburgh.

Only one other country, the Maldives, currently has a similar generational smoking ban in place. New Zealand previously enacted such a law but swiftly overturned it following a change in government in 2023.

While the Bill tightens regulations around vaping, it will remain legal for adults aged 18 or over to purchase vaping products.

The Tobacco and Vapes Bill was initially introduced in the House of Commons on 5 November 2024 and concluded its parliamentary journey when the House of Lords approved amendments made by MPs in the House of Commons on Tuesday, ahead of royal assent expected next week.
