The program for the first day, October 24th, will be conducted by the court. Judges and lawyers from Japan, Europe, the United States, and the United Kingdom held mock trials in their respective countries and regions using the same cases in which patent validity is being contested in patent infringement lawsuits. The court’s judgment on the following is stated. In the second half, a panel discussion was held with judges and lawyers from each country/region looking back on the mock trial, comparing the framework for determining patent validity, the way trials should be conducted, etc., deepening mutual understanding, and providing the latest information from each country/region. Opinions will be exchanged on intellectual property dispute procedures.
The program on the second day, October 25th, will be in charge of the Japan Patent Office. There will be lectures on the latest trends in the intellectual property judicial field in each country and region by the chief trial judge of the Japanese Patent Office, the chief trial judge of the United States Patent and Trademark Office, and the head of the European Patent Office’s legal trial division. Next, a mock oral hearing by the Japanese Patent Office will be held in a more realistic manner, including cross-examination of witnesses. Then, in a panel discussion format, opinions will be exchanged on themes such as oral proceedings and judgments on inventive step, etc., based on the hypothetical cases handled in the mock oral proceedings.

Panel discussion at the Patent Office part of last year’s symposium (JSIP2023). Judges from various Asian countries participated as panelists.
Through the two-day program, this symposium will be a valuable opportunity not only for lawyers and patent attorneys involved in intellectual property litigation, but also for industry and researchers to further deepen mutual understanding of the intellectual property judicial system and court system.
