Lawsuit Alleges Sexual Assault by Former NHL Player Willie Mitchell

The Allegations
The plaintiff, whose identity is protected by a publication ban, claims the assault occurred on September 11, 2022, after she finished a shift working as a server at Tofino Resort + Marina Inc. The resort was hosting a fishing tournament at the time, which was later cancelled in mid-september 2022,according to an archived snapshot of the resort’s website.
According to the civil claim, the woman went to the resort’s pub after her shift adn became “visibly impaired” by alcohol. She has only “fragmented” memories of the evening. The lawsuit alleges that mitchell escorted her from the pub while she was wearing only one shoe and transported her to his home, where he allegedly engaged in sexual activity without her consent.
The plaintiff reported the alleged assault to police the following day and underwent a forensic examination at a local hospital.
Claims Against the Resort
The lawsuit alleges that Tofino Resort + Marina Inc. was negligent in its service of alcohol to the plaintiff, contributing to her impaired state. The claim asserts that Mitchell was acting as an “agent” of the resort when he allegedly over-served her alcohol.
Plaintiff’s lawyer Sandra Kovacs emphasized the resort’s potential responsibility,stating,This girl ended up with one shoe and all of her belongings left at the bar,and so that speaks to,I say,her level of impairment.
kovacs further argued that the woman’s level of intoxication raises interesting questions into whether or not she truly had the capacity to consent.
Examination and Legal Context
The royal Canadian Mounted Police (RCMP) investigated the allegations,but Crown prosecutors declined to pursue criminal charges. Kovacs noted that civil lawsuits offer an choice avenue for seeking justice and examining preventative measures.
The lawsuit also seeks to introduce evidence from other potential complainants with similar experiences,suggesting a pattern of behavior. The allegations against Mitchell and the resort have not been proven in court, and no statements of defense have been filed as of October 3, 2025.
