Witch Fever Slams Download Festival’s Transgender Toilet Policy
Manchester-based band Witch Fever has added its voice to the growing chorus of artists protesting Download Festival’s policy regarding toilet access for transgender fans. This follows similar criticism from NOAHFINNCE and Pinkshift, who have also condemned the festival’s stance.
The controversy stems from a policy that seemingly prohibits trans women from using women’s restrooms and trans men from using men’s facilities. A screenshot shared by NOAHFINNCE indicated that Download Festival cited guidance from the Equalities and Human Rights Commission (EHRC) as justification for the policy, stating that “trans women (biological men) should not be permitted to use the women’s facilities and trans men (biological women) should not be permitted to use the men’s facilities.”
NOAHFINNCE responded sharply,questioning why Download Festival would invite trans artists to perform while simultaneously denying them the right to use appropriate bathrooms. The artist, who performed at the festival last year, stated thay would not return if trans attendees were forced to “out themselves” to use the restroom, creating an unsafe surroundings. They urged others to speak out against the policy.
Witch Fever echoed these concerns on Instagram, stating that forcing transgender individuals to use bathrooms that do not align with their gender identity poses a “complete fuckin tragedy” and threatens their safety. The policy appears to be influenced by an April 16 UK Supreme Court ruling that defined “woman” based on biological sex under the Equality Act. The Equality Human Rights Commission later issued guidance suggesting that trans women should not use women’s facilities in public spaces.
This guidance has faced backlash, with over 1,000 cultural figures signing an open letter arguing that it “overlooks the need to protect trans, non-binary and intersex people from discrimination.” The letter also noted that many leaders in the UK cultural sector are “unwilling” to police bathroom usage.
