Yukio Tanaka,59,an executive affiliated with the Kudokai yakuza group-designated as perilous under Japanese law-pleaded not guilty on Wednesday to the charge of fatally shooting Takayuki Ohigashi,the 72-year-old president of Osho Food Service,the company behind the Gyoza no Osho restaurant chain.
Tanaka stated, ”I’m definitely not the culprit,” in connection with the December 19, 2013, shooting of Ohigashi. The trial is being held at the Kyoto District Court under Judge Atsushi Nishikawa.
Challenges in establishing Guilt
A key challenge for prosecutors will be establishing a direct link between Tanaka and Ohigashi,as no such connection has yet been confirmed. The motive behind the murder also remains unclear, adding complexity to the case.
Sources familiar with the investigation indicate that the prosecution intends to rely heavily on circumstantial evidence to build its case and establish a potential background and context for the shooting.
Details of the Alleged Crime
According to the indictment, Tanaka is accused of shooting Ohigashi in the chest and stomach with a handgun in front of the Osho Food Service headquarters in Kyoto’s Yamashina Ward in the early morning hours of December 19, 2013.
Lay Judge Trial Request Denied
A request for a lay judge trial-which includes citizen participation in the judicial process-was previously rejected by the Supreme Court in November of last year. As a result, the case will be decided solely by professional judges.
