West Virginia Attorney General John Bohen McCuskey has filed a lawsuit against Apple, alleging the company knowingly allowed its iCloud service to become a repository for child sexual abuse material (CSAM). The suit, filed on , claims Apple prioritized user privacy over the safety of children, despite possessing the technical capabilities to detect and report such content.
The core of the complaint centers on Apple’s handling of CSAM stored on iCloud. While other major tech companies, including Google, Microsoft and Dropbox, utilize systems like PhotoDNA – a hashing and matching technology developed by Microsoft and Dartmouth College – to proactively identify and report known CSAM images, Apple’s reporting rate is significantly lower. According to the lawsuit, Google filed 1.47 million reports in 2023, while Apple filed only 267.
This disparity, the Attorney General argues, isn’t due to a lack of awareness but rather a deliberate choice. Apple maintains tight control over its hardware, software, and cloud infrastructure, giving it the ability to monitor content stored on its services. The lawsuit contends that Apple has “shirked their responsibility to protect children under the guise of user privacy,” as stated by McCuskey in a press release.

However, the plan was abandoned following strong opposition from privacy advocates who feared it could create a backdoor for government surveillance and potentially lead to censorship of legitimate content.
The proposed system, while intended to combat CSAM, raised concerns about the potential for abuse. Critics argued that the technology could be modified to scan for other types of content, infringing on users’ freedom of expression and potentially targeting political or religious activity. Apple, in a letter to an advocacy group, acknowledged these concerns, stating that scanning for one type of content “opens the door for bulk surveillance.”
Since abandoning the automated scanning initiative, Apple has implemented Communication Safety, a feature designed to warn children and blur images containing nudity detected in Messages, AirDrop, Photos, and FaceTime. However, the West Virginia Attorney General’s office argues that this measure is insufficient and falls short of the proactive steps taken by other tech companies.
The lawsuit seeks statutory and punitive damages, as well as injunctive relief, compelling Apple to implement more effective CSAM detection mechanisms. The state is arguing that Apple’s inaction constitutes a violation of consumer protection laws.
Apple responded to the lawsuit with a statement emphasizing its commitment to user safety and privacy. A spokesperson stated, “At Apple, protecting the safety and privacy of our users, especially children, is central to what we do. We are innovating every day to combat ever-evolving threats and maintain the safest, most trusted platform for kids.” The company also pointed to Communication Safety as an example of its ongoing efforts.
