Apple⁢ has filed a lawsuit against prominent tech leaker Jon Prosser, alleging he received and disseminated confidential data about unreleased iOS updates. The legal action has also resulted ⁤in the termination of⁢ an⁣ Apple employee, Ethan Lipnik, who is accused of providing access to a⁣ advancement device containing the sensitive data.

Prosser, known for ‍his detailed leaks ⁤of Apple⁢ product information, has not denied revealing details about an unreleased iOS ‍update.He showcased these details in a series⁣ of videos earlier this year, even describing the information as “the biggest iOS leak ever.” The lawsuit centers ⁣on how prosser acquired this information,with Apple alleging⁢ it originated from a development phone accessed by lipnik.

Employee ‍Termination and Apple’s Stance

The aftermath of the leak has been significant for Ethan Lipnik.According to the complaint, Apple terminated Lipnik’s employment for “failing to⁤ follow⁢ Apple’s policies ⁤designed to protect its confidential information, including ⁤development devices and unreleased software and features.” Neither ⁤Apple nor Ethan Lipnik have responded to requests⁢ for comment regarding ⁣the lawsuit or the termination.

Expert Analysis: Disparity and Due Diligence

Anshel Sag, principal analyst ‍at the tech research firm Moor Insights & Strategy, described ‍the lawsuit ‍as “quite ⁣significant.” He ‍noted a potential “disparity between what Prosser is saying and what Apple alleges, especially ⁣as the employee ⁤seemed to not be aware of ⁤what was going on.”

Sag highlighted⁢ a key issue: while the data was ⁣taken⁢ from a ‍development ⁣device that should ⁢have ⁣been ⁤better secured, the process of acquiring and verifying the⁢ information before its public release is also under scrutiny. “The biggest problem being⁤ alleged here,” Sag stated, “is that while the data was⁤ taken from a development device that should‍ have ⁣been better protected, how that data was acquired and where⁢ it came from should ⁣have been vetted before the details ⁣were ⁣put out into the world.”

Legal Ramifications and US Jurisdiction

Apple’s legal ⁢strategy appears to leverage US⁢ jurisdiction to its⁣ advantage. ‍Unlike many ancient Apple leaks that have originated from ⁤overseas, particularly from manufacturing partners in Asia, this case is alleged to have taken place within the United States, specifically California. This allows Apple to invoke federal laws such as the Defend Trade Secrets Act and the⁤ Computer Fraud and Abuse Act.”Ultimately, every‍ company fights ‍leaks, especially⁢ Apple, but with this happening entirely in the US the company has a lot more power and laws to support its ⁣efforts,” Sag explained.

Prosser’s⁢ Reaction and ⁢regret

Jon⁣ Prosser‍ stated that he only learned about the lawsuit through ⁣a MacRumors report. ⁤He ⁤expressed regret over Lipnik’s termination,⁤ saying, “I feel awful that⁢ Ethan was terminated over this.” Prosser added, “I wish he had ⁣shared with Apple what had occurred, and I wish that Apple would ⁣have connected with me for more answers-I⁣ would ⁤have gladly chatted‍ with them.”
