Tenants Endure Months of Disrepair, Tribunal Cites Public interest in Enforcement
Auckland, NZ – Tenants faced notable hardship for extended periods due to a series of unresolved maintenance issues in their rental property, culminating in a tribunal ruling that highlighted the importance of penalising landlords who fail to meet legal obligations.The case underscores the critical need for landlords to adhere to New Zealand’s healthy Homes standards, which became mandatory for all residential rentals from July 1st.
A Catalog of Neglect: From Faulty Locks to Escaping Dogs
For a staggering 40 weeks, the tenants were unable to use their front door due to a faulty lock, forcing them to rely on alternative entrances like the garage or side doors. This inconvenience was compounded by other persistent problems. Window locks with missing latches were never replaced, leaving the property vulnerable.A significant safety concern arose with a faulty oven door seal, which remained unrepaired for nine months. The tenants also experienced a prolonged period without essential appliances. The landlord-supplied fridge freezer failed, leaving the occupants without this vital appliance for eight weeks. During this time, they had to rely on a secondary, smaller fridge, also provided by the landlord, which struggled to maintain adequate cooling.
Further compounding the issues, gaps in the back fence were never repaired. this presented a constant challenge for the tenants, who had to implement makeshift solutions to prevent their dogs from escaping. This particular issue remained unaddressed throughout the entire tenancy.
Tribunal’s Stance: Public Interest and Landlord Accountability
The Tenancy Tribunal, in its ruling, emphasised that it is indeed in the public interest to penalise landlords who intentionally breach the law and fail to provide signed Healthy Homes standards statements.Tribunal member Michelle Pollak dismissed the landlords’ submission for non-publication of their names,signalling a commitment to openness and accountability in such cases. Attempts to contact the landlords for comment were unsuccessful.
Understanding Healthy Homes Standards
The Healthy Homes standards are a set of regulations designed to ensure all rental properties in New Zealand are warm, dry, and safe for tenants. Approximately 500,000 rental properties across the country are required to comply with these five key standards:
Heating: Ensuring adequate heating is provided.
Insulation: Meeting minimum insulation requirements in ceilings and floors.
Ventilation: Providing sufficient ventilation to prevent moisture buildup.
Moisture Ingress and Drainage: Addressing issues related to dampness and ensuring proper drainage.
Draught Stopping: Minimising draughts to improve warmth and energy efficiency.
Tenancy services, part of the Ministry of Business, Innovation and Employment, provides resources and guidance to help both landlords and tenants understand and comply with these vital standards. The Healthy Homes checklist is a key tool in this regard,clarifying the legal requirements for rented homes.
