Former Brazilian President Jair Bolsonaro is now under house arrest as investigations intensify into allegations he spearheaded a plot to undermine the countryS democratic institutions following his 2022 election loss. The dramatic escalation comes after authorities accused Bolsonaro of repeatedly violating court orders and perhaps orchestrating an attempt to illegally retain power.
Sanctions and Legal Scrutiny
The U.S. imposed sanctions on Bolsonaro and several of his allies earlier this month, citing concerns over their actions surrounding the January 8, 2023, riots in Brasília - an event widely seen as an attempt to destabilize the government. These sanctions were imposed under Executive Order 13818, issued during the Trump administration in 2017. The order declared a national emergency concerning global human rights abuses and corruption and expanded upon the Global Magnitsky Human Rights Accountability Act passed in 2016. This legislation empowers the U.S. government to impose financial and travel sanctions on foreign officials accused of human rights violations and corruption. The sanctions block any U.S. assets belonging to the designated individuals and prohibit Americans from conducting financial transactions with them.
Despite growing international pressure, the Brazilian government has yet to issue a formal response to the U.S.sanctions.
Details of the Case
Brazilian prosecutors allege that bolsonaro led a coordinated effort to delegitimize, and ultimately overturn, the results of the 2022 election. This included spreading misinformation about the voting process, encouraging protests, and allegedly planning violent acts, even an alleged assassination plot targeting President Luiz Inácio Lula da Silva and Justice Alexandre de Moraes.Bolsonaro lost the election by a narrow margin, a result he has consistently disputed.
The investigation centers around accusations that Bolsonaro and his allies attempted to use the military to intervene and prevent Lula da Silva from taking office. Evidence presented by prosecutors includes draft decrees allegedly intended to declare a state of emergency and justify military intervention. Moreover, communications seized by investigators reportedly detail discussions about strategies to discredit the electoral system and sow doubt among the population.
A panel of Supreme Court justices accepted the charges in March, ultimately ordering Bolsonaro to stand trial. Monday’s house arrest ruling builds on earlier restrictions: an ankle monitor, a nighttime curfew, and a travel ban keeping the former president confined to Brasília despite his deep political roots in Rio de Janeiro. The repeated violations of these restrictions, including alleged attempts to tamper with his electronic monitoring device, prompted the stricter measure of house arrest.
