Belfast, UK – A 37-year-old man, facing serious allegations of human trafficking, has been denied bail by a judge who cited significant flight risk concerns. The defendant, who has overstayed his visa in Northern Ireland, was remanded into custody pending further proceedings.
Overstayed visa and Flight Risk
During a bail hearing,DC Beggs highlighted the defendant’s immigration status, stating,”released the defendant could travel back to Bulgaria and not return.” Further information from immigration authorities confirmed that the 37-year-old “has overstayed his current visa.”
While acknowledging the defendant’s clear record in northern Ireland, DC Beggs expressed apprehension.”Obviously with the nature of the allegations that the defendant has been human trafficking, we would be concerned that even without a passport, there may be ways and means that he could get out of the country or move country and therefore be a flight risk.”
Defense Arguments for bail
The defence counsel argued for bail, emphasizing the defendant’s consistent denial of the offences during police interviews and his entitlement to the presumption of innocence. The barrister pointed out that the defendant has been living and working in Northern Ireland for several years. To support the bail application, the defendant’s wife was present in court with £2,200 to lodge as a cash surety, suggesting that bail could be granted with a package of conditions.
“How is this man suppose to leave the country when police have seized his passport, they’ve seized all his national identity cards,” the barrister questioned, attempting to allay fears of absconding.
Judge’s Decision
Though, Judge O’Hare was not convinced that any conditions could adequately mitigate the perceived risk. He stated, “I do not believe there are conditions that I can impose that would alleviate that risk.”
Consequently, bail was refused, and the defendant was remanded into custody. The case has been adjourned to August 14th.
