Consumers Lose Lawsuit Seeking Damages in Radon Bed Incident

In a disappointing outcome for consumers, the first trial of a lawsuit seeking collective damages related to the infamous ‘radon bed incident’ has been lost. The incident caused widespread alarm when radioactive materials were discovered in the beds.

The Civil Settlement Division of Seoul Central District Court 30, led by Chief Judge Jeong Chan-woo, ruled against the plaintiffs in a lawsuit filed by approximately 480 users, including Mr. Lee, seeking damages worth 4.8 billion won from Daejin Bed, DB Insurance, and the government.

Radon Bed Controversy

The ‘radon bed controversy’ began in May 2018 when radon, a known class 1 carcinogen, was found in Daejin’s bed mattresses. Radon is a substance that emits radiation and is known to cause lung cancer, posing a potential health risk to those exposed to it in their homes.

At the time, the Nuclear Safety and Security Commission revealed that the radiation exposure from the implicated mattress exceeded the standard by up to 9.3 times. In response, consumers demanded a full recall of all mattresses, but Daejin Beds’ response was slow, leading to further escalation of the situation and government intervention.

In July of the same year, around 480 consumers, including Mr. Lee, filed a lawsuit seeking damages of 10 million won each against Daejin Beds, insurance companies, and the government.

During the trial, Mr. Lee and other plaintiffs argued that constant exposure to radiation from the Daejin bed mattresses greatly increased the risk of developing diseases such as thyroid disease, leukemia, and cancer.

DB Insurance, on the other hand, contended that their involvement in the sale of the mattresses and their product liability insurance contract with Daejin Beds, which covered up to 100 million won per person or property accident, obligates them to provide compensation to the affected consumers.

Additionally, the country’s Nuclear Safety and Security Commission ordered Daejin Beds to pay damages, including medical expenses and alimony, citing a breach of their obligation to protect public health and the environment from ambient radiation.
