Controversy in China: Woman Gives Birth to Son from Frozen Embryos to Inherit Partner’s Estate

There is controversy in China after a woman became pregnant with frozen embryos and gave birth to a son in order to inherit the inheritance after the death of her romantic partner.

According to Hong Kong’s South China Morning Post on the 26th (local time), the incident began when a man, Wen, died in a traffic accident in January 2021.

Suddenly, Mr. Ling, who claimed he was having an affair with Mr Won, filed a property department lawsuit against his wife.

Mr explained. Ling, that before Mr Won’s death, a number of eggs fertilized by Mr Won’s sperm were frozen in a private hospital. After that, it was announced that she gave birth to a boy named ‘Xiaowon’ in December 2021.

Mr Ling believed that Xiaowen had the right to inherit part of his deceased father’s property, Mr. Wen, who filed the lawsuit on behalf of his son in August last year.

Mr. Ling claimed that he had given birth to Mr. Won’s son and that he should share some of Mr. Won’s assets, including Won’s death insurance money, real estate, and company shares, with Xiaowen.

However, the local court ruled that “artificial insemination or embryo implantation after the death of Mr. Won without the consent of the bereaved family violates public order and cannot receive legal protection.”

In addition, during the case, Mr. Ling can prove that the frozen egg was fertilized by Mr. Won and that he has permission to use Mr.’s sperm. Won to have a child. Accordingly, the court dismissed Mr Ling’s lawsuit.

A lawyer from a Beijing law firm said, “The Civil Code enacted in 2021 states that any fetus living in the mother’s body has the right to receive inheritance and gifts. However, it is not stated in law do frozen embryos have the same rights.” “It’s a blur,” he said.
