Declan Ganley Alleges ‘Significant Harm’ in Rivada Networks Shareholder Dispute
telecom Mogul Declan Ganley Alleges Fraud in Bitter Legal Battle
Delaware Courtroom Becomes Battleground for Rivada Networks Shares
A high-stakes legal battle is unfolding in delaware, pitting Irish telecom entrepreneur Declan Ganley against private equity investor David Shuman. Ganley, founder of Rivada Networks, alleges he’s been the victim of a “scheme to defraud” orchestrated by Shuman, resulting in significant financial and reputational damage.
The dispute stems from a 2017 loan agreement Ganley secured from Worth capital, using his Rivada shares as collateral. Shuman acted as a guarantor on the loan. When the loan defaulted, Shuman took control of both the debt and the shares, sparking a multi-jurisdictional legal war.
Ganley claims Shuman’s actions were part of a purposeful plan to seize control of his Rivada shares. He alleges Shuman “wrongfully obtained” a default debt judgment in New York, currently exceeding $21 million.
“This is a case of blatant fraud and unjust enrichment,” Ganley asserts in court filings. he seeks tens of millions in compensatory damages, punitive damages, legal fees, and the return of his Rivada shares.
Ganley argues that the original debt was repaid in 2020 through fresh investments in Rivada. He accuses Shuman of attempting to “double or triple recover” on the debt and using legal maneuvers to “extort” him.
Shuman’s legal team vehemently denies these allegations. Richard Schoenstein, Shuman’s attorney, maintains that his client has “prevailed in every court thus far” and that Ganley has failed to produce evidence to support his claims.
“Mr. Ganley is behind on court-ordered payments but somehow manages to have lawyers file new claims rehashing his tired allegations,” Schoenstein stated.
The legal battle has taken a toll on Ganley, who claims to have suffered “significant monetary harm” and “reputational harm to both mr. Ganley and his business interests in the U.S. and abroad.”
This complex case highlights the high stakes involved in high-finance deals and the potential for bitter disputes when agreements go sour. The outcome of this legal battle will have significant implications for both Ganley and Shuman, as well as the future of rivada Networks.
