The investigation results determined that defendant Truong My Lan is the Chairman of Van Thinh Phat Group, including a set of subsidiaries and affiliated companies. In order to have a large source of capital to serve the operations of the above company system as well as to continuously invest and buy real estate projects, Truong My Lan has sought to acquire, dominate and run all activities. of SCB including lending activities.

Before the merger, Truong My Lan owned the majority of shares in 3 banks. After the merger, Ms. Lan increased her share ownership in this bank to 91.5%.

Truong My Lan has recruited and placed trusted and qualified individuals in the fields of finance and banking, following Lan’s direction, into key leadership positions at SCB Bank (Board of Directors, Board of General Directors, Directors of large branches, Head of the Supervisory Board), pay high salaries from 200 to 500 million VND/month; donate, reward money, SCB shares, to use these individuals to manage all operations of SCB Bank.

By acquiring, holding shares, controlling, and operating banking activities through key entities, Truong My Lan has used SCB Bank as a financial tool, mobilizing deposits and capital from other sources, then directed to withdraw money by creating fake loans for personal purposes.

To withdraw money from SCB, Truong My Lan managed and directed trusted individuals, holding key roles at SCB Bank and the Group to direct subjects at SCB Bank and Van Thinh Phat Group. organized the establishment of many departments, units, companies, hired and employed thousands of individuals, closely colluding with each other, colluding with valuation companies, and withdrawing money from SCB.

Ms. Lan also directed the establishment of “ghost” companies and then hired people to act as legal representatives, shareholders, company members, choose business lines… to suit Truong My Lan’s requirements. and accomplices. There are more and more “ghost” companies and individuals hired/in their name to serve the purpose of withdrawing money from Truong My Lan’s SCB Bank.

The results of the investigation determined that there were 875 customers including 440 individuals and 435 legal entities with 1,284 loans under their names, which Truong My Lan directed a group of subjects at VTP Group to establish, hire or ask someone to sign.

In addition to creating “ghost” companies in the name of loan applications, Truong My Lan also colluded and directed subjects who were owners, legal representatives or assigned to manage real companies with business activities so that these companies can borrow capital in their names or create more “ghost” companies, create documents, fake loan plans, and withdraw money from SCB Bank for Truong My Lan and the above subjects. on the same use.

Whenever it is necessary to withdraw money from SCB, Truong My Lan instructs her subordinates to create documents and plans for fraudulent loans to make it legal; bring individuals hired/asked to sign the loan, property, or “ghost” company representative to sign the false loan application. The representatives of the legal entity and the individual whose name is on the loan are not entitled to enjoy and use the money, and do not know that they are borrowing and owing SCB a particularly large amount of money; Those whose names are on the property all confirm that it is not their property. Most of Truong My Lan’s loans are disbursed first and legally implemented later.
