Deputies support punishing the sale of adulterated or expired medicines with imprisonment

The Health Commission, chaired by deputy Emmanuel Reyes Carmona belonging to the Morena party, approved four opinions that reform various articles of the General law of healthon medications, breast milk donation, rare diseases and private medical services.

It was endorsed with 27 votes in favor, one against and one abstention, reform article 464 Ter of the General Health Law.

With this modification it is stipulated that whoever sells or offers for sale, trades, distributes or transports medicines, drugs, raw materials or additives that are falsified, altered, contaminated or adulterated, “expired or whose useful life has ended” whether in establishments, ” as well as on the Internet through electronic commerce platforms and social networks”, or in any other place, or sell or offer for sale, trade, distribute or transport materials for packaging or packaging of medicines, pharmaceuticals, raw materials or additives, his legends, information that contains numbers or identification keys, which are falsified, altered or adulterated, a penalty of “three to 15 years in prison” and a fine of twenty thousand to fifty thousand days of minimum wage will be imposed.

The same penalty is proposed to anyone who sells, offers for sale or trades medical samples, whether in establishments, via the Internet or anywhere else.

The ruling also increases the prison sentence, which is currently from three to 15 years, to apply from five to 20 years in prison to anyone who adulterates, falsifies, contaminates, alters or allows the adulteration, falsification, contamination or alterations of medications, drugs . , raw materials or additives, of its final packaging for human use or consumption or manufactures them without the registrations, licenses or authorizations established by law.

Likewise, the penalty will increase for anyone who falsifies or adulterates or allows the adulteration or falsification of material for packaging or packaging of medicines, labeling, its legends, the information it contains or its identification numbers or keys; goes from one to nine years in prison to a sentence of three to 15 years.

Reform on breast milk donation approved

Another opinion is to the minute that adds a section II Ter to article 64 of the General Health Law, to establish thatThe Ministry of Health will promote permanent dissemination, education and promotion actions for breast milk donation and breast milk bank services among the population.
