Swiss environmental Groups Drop Referendum Bid on Accelerated Energy Project

Six major Swiss environmental organizations have decided not to launch a referendum challenging a new law designed to accelerate the approval process for renewable energy projects.The organizations-Pro Natura, Birdlife, WWF, Greenpeace, the ATE, and the Swiss Energy Foundation, collectively known as the Alliance for the environment-announced their decision on Saturday, october 4, 2024. They stated they will rather focus on ensuring the rapid growth of renewable energies in a way that respects natural environments.
Streamlined Approvals, Limited appeals
The decision follows the Swiss Parliament’s adoption of the acceleration decree during its fall session. The law aims to expedite the planning and authorization of large-scale solar, wind, and hydroelectric power plants by simplifying procedures and limiting the ability of opponents to appeal project approvals. RTS reports that the changes specifically restrict the right to appeal for certain renewable energy projects.
A key component of the legislation simplifies procedures for 16 hydroelectric projects previously approved by voters in cantons including Valais, berne, Graubünden, Ticino, and Uri.These projects include a new retention lake near Zermatt (Valais) and an expansion of the Lake Grimsel reservoir. Under the new rules, only cantonal courts will be able to review these projects for compliance with environmental law, effectively removing the Federal court’s oversight.
Concerns Over Due Process
The Alliance for the Environment criticized the limited appeal process, arguing it is indeed “truncated and inappropriate.” They pointed out that even minor offenses, like parking tickets, can be appealed to the Federal Court under the Swiss legal system.
Despite their concerns about the reduced right to appeal, the organizations expressed confidence that the 16 major projects can be implemented in an environmentally responsible manner. They emphasized their firm opposition to any further weakening of appeal rights beyond this specific decree.
Political Context
The decision to forgo a referendum was anticipated. While the Green Party and the Social Democratic Party (PS) voiced reservations during parliamentary debates about the limitations on appeal rights, they ultimately supported the project, recognizing its importance for Switzerland’s energy transition. The energy transition, or *Energiewende*, is a key priority for left-leaning political parties in Switzerland.
