The timing of sexual misconduct allegations against Rep. Eric Swalwell, surfacing weeks before the California gubernatorial primary, has prompted questions regarding why the accusers are coming forward only now. However, such questioning often overlooks the fundamental nature of trauma and the psychological barriers survivors face when reporting abuse by powerful figures.
Rep. Eric Swalwell, a congressman and leading candidate for governor of California, is facing accusations from four women who describe a pattern of sexual misconduct. These allegations include claims of sexual assault and rape, with some accusers identifying as former staffers.
Details of the Allegations
Reporting from the San Francisco Chronicle and CNN has detailed specific accounts of non-consensual encounters. One former congressional staffer alleged that Swalwell sexually assaulted her on two separate occasions when she was too intoxicated to consent. According to the San Francisco Chronicle, these interactions began in 2019, at a time when the woman was 21 years old and had been newly hired to work in the congressman’s district office located in Castro Valley.
A second former staffer provided a different account to CNN, detailing an incident that occurred in April 2024. She stated that after a night of drinking with Swalwell in New York City, she was heavily intoxicated and woke up to find him having sex with her in his hotel bed.
In total, four women have come forward to describe sexual misconduct involving the representative.
Legal Investigations and Internal Fallout
The allegations have moved beyond media reports into legal scrutiny. On April 11, 2026, the Manhattan District Attorney’s Office announced it is investigating the claim made by the former staffer regarding the April 2024 incident in New York City. The D.A.’s office issued a statement urging anyone with knowledge of the allegations to come forward.
The accusations have also caused significant instability within Swalwell’s own political operation. An unsigned statement from Swalwell’s staffers, obtained by ABC7 and released on April 11, 2026, indicated that the staff were horrified
by the allegations. The statement read:
We stand with our former colleague, and the other women who have come forward. We believe you should stand with them, too.
Statement from Rep. Eric Swalwell’s staff
Following these reports, Politico reported on April 10, 2026, that Swalwell’s campaign for governor was reeling, with multiple staffers resigning and prominent allies distancing themselves from the candidate.
Defense and Campaign Response
Rep. Eric Swalwell has denied all allegations of sexual assault and misconduct. In a statement released on April 10, 2026, his campaign described the claims as anonymous election eve claims
and stated they are categorically false
.
Swalwell defended his record, stating that he has served the public for nearly 20 years as a prosecutor and congressman and has always protected women
. He asserted that he would defend himself with facts and would bring legal action where necessary.
On April 9, 2026, an attorney representing Swalwell sent a cease-and-desist letter to the woman who spoke with the San Francisco Chronicle. The letter claimed she had made false statements accusing Mr. Swalwell of sexual assault and nonconsensual sexual encounter
and threatened legal action if the allegations were not retracted.
Despite the pressure from the investigations and the resignations within his campaign, Swalwell initially stated that he would not drop out of the California governor’s race.
