Man Sentenced to 2 Years in Prison for Reselling Ancient Vertebrate Fossils
Recently, Linxia County Court held a trial on a case of reselling cultural relics. The defendant, Ma Moumou, was sentenced to two years in prison and fined 10,000 yuan.
Ma Moumou had been purchasing ancient vertebrate fossils from Ningxia since 2020, processing them at home, and selling some of them. In 2023, the Linxia County Public Security Bureau discovered and arrested him while investigating a case of reselling cultural relics, and seized suspected ancient vertebrate fossils at his home. After identification by experts from the National Paleontological Fossil Expert Committee, there was one second-level ancient vertebrate fossil, five third-level ancient vertebrate fossils, and 27 generally protected ancient vertebrate fossils.
The court held that Ma Moumou resold the fossils of ancient vertebrates with scientific value protected by the state for the purpose of profit, which was a serious crime and constituted the crime of reselling cultural relics. After his arrest, he truthfully confessed his crime, pleaded guilty and accepted punishment, and actively paid the illegal gains and fines. Based on the defendant’s criminal facts, circumstances, legal consequences, and attitude of confession, and in accordance with the relevant provisions of the Criminal Law of the People’s Republic of China, the above judgment was made.
The judge emphasized the importance of cultural relics protection, stating that cultural relics carry brilliant civilizations, inherit historical culture, and are precious cultural materials that have survived. The ancient animal fossils in this case provide very precious physical evidence for domestic and even international research on the living habits, reproduction methods, and ecological environment of animals and plants at that time. They are of immeasurable value for studying paleogeography, paleoclimate, the evolution of the earth, and the evolution of organisms in the geological period.
