Dominion, Fox News Head to Trial Over Election Claims
A closely watched defamation trial is set to begin between Dominion Voting Systems and fox News. The legal battle stems from Fox news’ coverage of the 2020 election and repeated promotion of false claims about Dominion’s voting machines.
Dominion filed its Dominion lawsuit in 2021, alleging that Fox News knowingly broadcast false information that the company’s machines rigged the election by switching votes from Donald Trump to joe Biden. The voting machine company argues that these claims,aired primarily in November and December 2020,caused meaningful damage to its reputation and business.
To win the case,Dominion must prove that Fox News acted with “actual malice,” meaning the network either knew the claims were false or recklessly disregarded evidence that they were false. Dominion contends that Fox promoted these conspiracy theories because “the lies were good for Fox’s business.”
The defamation lawsuit specifically targets shows hosted by Lou Dobbs, Maria Bartiromo, Tucker Carlson, Sean Hannity, and Jeanine Pirro. Dominion asserts that Fox’s “orchestrated defamatory campaign” resulted in “enormous and irreparable economic harm,” as well as death threats and harassment against its employees.
Fox News defends its coverage by arguing that it was simply reporting on newsworthy claims and that the lawsuit is a meritless attack on press freedoms. A Fox spokesperson stated that the network “is proud of our 2020 election coverage” and that it “stands in the highest tradition of American journalism.” The company argues that Dominion’s lawsuit is a “political crusade in search of a financial windfall, but the real cost would be cherished First Amendment rights.”
Fox has also accused Dominion of creating “noise and confusion” around the case, maintaining that “the core of this case remains about freedom of the press and freedom of speech, which are fundamental rights afforded by the Constitution,” specifically the First Amendment.
