Gold Smuggling case kerala high court set interim stay on judicial inquiry against enforcement directorate | High Court stays state government’s judicial inquiry against ED

Kochi : Gold smuggling case (Gold Smuggling Case) A setback for the state government. Against the Central Agency Enforcement Directorate investigating the case (ED) High Court upholds the action of the State Government in appointing a Judicial Commission for Inquiry (High Court) Stay tuned. The court ruled in favor of an interim stay.

The court’s order came on a petition filed by ED questioning the state government’s action in appointing a Judicial Commission to probe the central agency. The interim order was issued by a single bench court.

The ED pointed out in their petition that the state government does not have the power to appoint a Judicial Commission against the central agency. The ED had earlier alleged that the Chief Minister had misused his official position to appoint a Judicial Commission to sabotage the gold smuggling probe.

But the government argued in court that the ED’s petition against the Judicial Commission would not stand. The court rejected this and granted an interim stay on the government’s decision.

The court will send notices to the parties in the case, including the Chief Minister, the Additional Chief Secretary and the state government. The case will continue after this.
