Government’s Plan to Deposit Compensation for Forced Labor Victims Disrupted

Government’s Effort to Deposit Compensation Money for Forced Labor Victims Disrupted

A recent plan by the government to deposit the compensation money for four forced labor victims, who rejected the court’s “third party offer,” has hit a roadblock. The Ministry of Foreign Affairs began the process of depositing the judgment money and delayed interest into the court as required, but the Gwangju District Court has decided to reject this move, citing a “non-repair decision.”

Grandma Yang Geum-deok’s deposit, referred to as “Bullying,” and Grandpa Lee Chun-shik’s deposit, known as “Companion,” both faced obstacles. The adoptive grandmother clearly expressed her refusal to deposit by submitting documents to the court stating “no refund allowed.” In the case of the grandfather, his lack of deposit documents led to a similar outcome.

Expressing deep regret over the court’s decision, the Ministry of Foreign Affairs emphasized that the government had already undergone a rigorous legal review for the deposit and found it difficult to accept the court’s decision based on legal principles. The Ministry plans to initiate an appeal process immediately and seek the correct judgment from the court.

Furthermore, the Ministry highlighted the established Supreme Court precedent that emphasizes the right to a formal examination of public officials and the mechanical processing of deposit matters.

Notably, the Citizens’ Group for Forced Removal under Japanese Occupation has promptly protested the government’s decision to deposit the compensation money in court, deeming it ineffective. According to the group, the deposit violates Article 469 of the Civil Code, which states that if a third party expresses their statement of refusal, the refund cannot be allowed. This act, coupled with the ongoing campaign to raise funds for support, is perceived as an attempt to neutralize the group’s efforts.
