House approves Use of Force Rules

Previously, the Minister of the Interior, Carolina Tohá, had already announced that they would reserve constitutionality if this rule was approved by the deputies.

The Chamber of Deputies approved unanimously the article that establishes the Rules for the Use of Force (RUF) for police and Armed Forces.

On the other hand, It was rejected the indication added in the united commissions of Constitution and Citizen Security that military courts are those that have jurisdiction over crimes committed by uniformed officers in four scenarios: in a state of constitutional exception, protection of critical infrastructure, border areas or electoral processes.

In the previous one, the Minister of the Interior, Carolina Tohá, had already announced that they would make a constitutionality reservation if this rule was approved by the deputies, within the framework of the Rules for the Use of Force.

Use of Force Rules

For Tohá this indication “has a single logic; show once again to the citizens that some are with the Armed Forces and others are not. I think that the Armed Forces, when they see this debate or police, feel desolate, not supported. “They feel that there is great confusion here, that we don’t know where we are going.”

Despite this setback, Chile Vamos and the opposition hope to restore the jurisdiction of the military courts in the discussion in the Senate.

“We regret that military justice has not been approved, without a doubt that the Senate has a pending task regarding that, because what we need are guarantees so that the armed forces and the police can carry out public order tasks as they should, without their freedom being in danger,” declared deputy Andrés Longton (RN).
