The International Criminal Court unsealed arrest warrants against four senior Taliban leaders on October 5, 2026, accusing them of crimes against humanity for gender persecution against women, girls, and members of the LGBTQI+ community in Afghanistan since 2021. The unsealing brings the Taliban leadership under direct international scrutiny, though the prospect of arrest remains remote because the court lacks a police force and the Taliban control the country, thehindu.com reported.

International Criminal Court Issues Warrants for Supreme Leader and Ministers

Warrants were issued in July and September of last year for Taliban supreme leader Hibatullah Akhundzada and the head of Afghanistan’s Supreme Court, Abdul Hakim Haqqani, according to thehindu.com. The existence of those warrants was revealed last year, but the documents remained sealed until October 5, 2026. The court also unsealed warrants for Education Minister Habibullah Agha and Minister of Higher Education Neda Mohammad Nadim, news18.com reported.

The four suspects are charged with persecution on gender grounds against girls, women, and individuals who do not conform with Taliban policies on gender or gender expression. They also face political charges regarding persons perceived as allies of women and girls, thehindu.com noted. Judges stated that the four suspects implemented government policy resulting in severe violations of fundamental rights, including murder, imprisonment, torture, rape, and enforced disappearance.

Taliban Rejection and Ongoing Restrictions in Afghanistan

Since retaking control of Afghanistan in 2021, the Taliban have barred women from jobs, most public spaces, and education beyond sixth grade, thehindu.com reported. Last year, Akhundzada banned buildings from having windows that look into places where a woman might sit or stand.

Afghan government spokesman Zabihullah Mujahid condemned the court decision in a written statement cited by thehindu.com. Mujahid stated that Afghanistan does not recognize any court under the title of the International Court and attaches no significance to its positions. He added that the administration is bound by Islamic Sharia rulings rather than intelligence entities.

Unsealed Charges Contrast With Remote Enforcement Prospects

While news18.com described the unsealing as a major legal development that escalates the court investigation into Afghanistan, thehindu.com emphasized that actual arrests remain unlikely because the court has no police force. Former ICC chief prosecutor Karim Khan announced in January of last year that he had requested warrants for Akhundzada and Haqqani, stating that Afghan women, girls, and the LGBTQI+ community face unprecedented and ongoing persecution by the Taliban, according to thehindu.com.
