A speeding incident involving a BMW on the R238 regional road in Drumfries has resulted in a €320 fine for an Inishowen woman. Linda skelly, residing in Benduff, Carndonagh, failed to appear at Buncrana District Court to address the charge of driving at an excessive speed.
Court Proceedings and Evidence Presented
Judge Eiteain Cunningham presided over the case and, after being presented with evidence confirming Ms. Skelly had been duly notified of the proceedings, directed that the case coudl proceed in her absence. “Ms. Skelly is not present in court, nor has she instructed a solicitor to attend on her behalf,” stated Judge Cunningham. “I am satisfied that she has received the summons as served,and in the circumstances,I’m going to proceed in her absence.”
GoSafe Operator’s Testimony
The court heard evidence from a GoSafe operator who was stationed on the R238 at Owenboy, Drumfries, on Tuesday, December 17, 2024. The operator was utilizing a speed detection device on the regional road, where the posted speed limit is 80 kilometres per hour.
At approximately 8:18 PM that evening, the operator recorded a 132-D registered BMW 5 Series travelling at 103 kilometres per hour within the 80kph zone. Following standard procedure, the GoSafe operator reported the infraction, leading to the issuance of a fixed charge penalty notice to ms. Skelly. The notice, however, remained unpaid, with the operator presenting a certificate to the court as proof.
Verdict and Sentencing
Upon reviewing the evidence presented,Judge Cunningham declared herself “satisfied the facts have been proven.” Consequently, ms. Skelly was convicted of the motoring offence. She was ordered to pay a fine of €320, with a grace period of five months granted for payment.
