Federal Judge Rejects OpenAI Bid for Apple and Musk Venture Settlement Terms

The federal court reviewed the materials privately and determined that the documents do not contain information relevant to the remaining antitrust claims.

Collusion Allegations and App Store Visibility Restrictions

The legal dispute centers on allegations that Apple and OpenAI colluded to block competing artificial intelligence applications from the market, including by restricting their visibility on the App Store, as reported by 9to5mac.com. Both companies have consistently denied those claims.

The antitrust litigation shifted when X and SpaceXAI informed the federal court that they reached an agreement with Apple and would move to dismiss their claims against the iPhone maker. Following that notice, OpenAI filed an emergency motion to inspect the confidential settlement terms, arguing the document might help build its defense for the remainder of the lawsuit.

Private Court Inspection and Judicial Findings

To evaluate the request, Judge Pittman ordered X and SpaceXAI to submit the settlement agreement to the court for a private inspection. Following that review, the judge ruled against disclosing the text to OpenAI.

Generally, courts are reluctant to order the disclosure of secret settlement accords settled upon by litigants. […] On occasion, tribunals have allowed the disclosure of private settlement contracts provided they feature details pertaining directly to matters central to a trial or summary judgment. Upon performing a private examination of the sought-after documents, though, the Court concludes that they lack material relevant to the matters slated for resolution during trial or summary judgment in this matter.

Upcoming Summary Judgment Motion and Trial Impact

With the settlement terms kept private from OpenAI, the litigation will proceed solely against the AI developer.
