Korea Government Proposes Platform Law to Regulate Tech Giants’ Abuse of Power

The government has decided to legislate to proactively regulate platform companies with monopolistic positions such as Google, Naver, and Kakao.

The aim is to stop the abuse of power by online dinosaurs.

However, voices oppose the bill, saying that it doubles regulation and reverses discrimination, so difficulties are expected in the legislative process.

Kakao Mobility was approved by the Fair Trade Commission for handling the dispatch algorithm to call connected taxis only.

Naver manipulated the algorithm to ensure its products were searched first, and Google was caught preventing game companies it deals with from releasing games on rival app markets.

However, competitors had already suffered losses, and their market power had become stronger.

Accordingly, the government decided to enact the ‘Platform Competition Promotion Act’, which designates a small number of monopoly platforms as dominant operators and imposes immediate sanctions on those who engage in foul play, such as giving preferential treatment for their own companies.

The Fair Trade Commission intends to confirm regulatory targets soon by referring to legislative examples in the European Union (EU) and Germany.

“Along with the benefits of innovation in the platform market, side effects such as the harmful effects of monopoly also appear. The platform market has the characteristic that monopolization progresses very quickly and is not easy to correct.”

However, the industry strongly opposes the law, saying it will destroy the digital economy.

The Digital Economy Alliance, in which the Korea Internet Corporation Association and others participate, issued a statement stressing that “the introduction of previous regulations on online platform companies is a step backwards for Korea’s future economy.”

The American Chamber of Commerce in Korea also said, “We take this very seriously and express great concern.”

There is a negative opinion that it is overlapping regulations, and there is a big difference in the views of the ruling opposition parties and the opposition parties in the National Assembly, so difficulties are expected in the legislative process.
