Korean Medical Residents Sue Government: Fight for Rights and Freedom

More than 70 days have passed since the resident left the hospital, and about 30 people, including representatives of residents’ groups, have filed a lawsuit seeking the annulment of various orders issued by the government.

Dan Park, chairman of the emergency committee of the Korean Medical Association (Daejeon Association), appeared at the Seoul Administrative Court on the afternoon of the 3rd and filed a complaint.

President Park told reporters that day, “We are proceeding with an administrative case to respond to the order to begin work, the order to maintain medical treatment, and the order to prohibit the acceptance of letters of resignation.” The target is Cho Gyu-hong, Minister of Health and Welfare.

President Park said: “Residents are contract doctors who are paid the minimum wage and work more than 80 hours a week, which is double the Labor Standards Act,” and added: “They have the right to independently decide whether to complete training and work, but their resignations are not accepted due to a government order. “The freedom to choose a career is violated,” he said.

He added: “The government’s executive order is excessive and unreasonable” and added: “I hope it will be rescinded now.”

The number of participants in the trial is expected to increase further. Lawyer Jeon Seong-hoon, who represents the case, said: “The lawsuit was mainly filed by representatives of Daejeon Cooperative and representatives of the training hospital,” and added: “Other people have also contacted us and we have intention to further verify and add additional plaintiffs. It was also said that a separate constitutional petition was under consideration.

President Park said: “I am not in the position to reveal anything about other pending matters, such as the court’s recent request for a basis to increase the number of staff by 2,000 or the Korean Medical Association’s proposal for a ‘pan-wide community dialogue -doctor’. “

In addition to these, 1,360 major sajiki also sued Minister Cho Gyu-hong and Second Vice Minister Park Min-soo on charges of abuse of power and obstructing the exercise of rights on the 15th of last month.
