Judge Denies Release for Palestinian Activist Mahmoud Khalil
A federal judge has declined to order the release of Mahmoud Khalil, a Palestinian activist and former Columbia University student. This decision comes after a previous ruling against the Trump administration’s efforts to keep him detained.
Khalil, a green-card holder, has been held as March and has not been charged with any crime. He has become a prominent figure in the debate over the U.S. government’s approach to pro-Palestinian activism on college campuses. His detention caused him to miss the birth of his son.
Earlier in the week, khalil’s advocates expressed optimism after Judge Michael E. Farbiarz ruled that the Trump administration could not detain Khalil based on claims that he posed a threat to U.S. foreign policy. Farbiarz, sitting in New Jersey, deemed the deportation efforts on those grounds likely unconstitutional.The administration did not appeal the order by Friday morning’s deadline.
Khalil’s legal team then argued for his immediate release. Though,the government stated its intention to keep him detained at a facility in Louisiana,citing alleged discrepancies on his green-card application as justification.
On friday, Farbiarz stated that Khalil’s lawyers had not provided sufficient evidence to prove that the detention based on the green-card claims was unlawful.He suggested that Khalil’s attorneys could seek bail from an immigration judge in Louisiana.
Khalil’s representatives have consistently refuted the government’s claims regarding his green-card application, asserting that thay are a pretext for his continued detention.
“Mahmoud Khalil was detained in retaliation for his advocacy for Palestinian rights,” said Amy Greer, one of his attorneys, on Friday evening.
