Discovery of Irregularities in Silvia’s Aqueduct, Sewer and Cleaning Company
The General Manager of Cauca found a finding with a tax impact value of $9,490,951 in the Aqueduct, Sewer and Cleaning Company Silvia ESP (Emsilvia ESP), corresponding to the validity of 2023.
The audit process included a review of 12 agreements of a total of 36, which represents a 48.77% revised total contractual value, equivalent to $171,069,094. During the review, the Manager’s Office established six (6) administrative comments, one with alleged disciplinary incident and one with alleged tax cases.
The company Emsilvia ESP did not comply with the provisions of the Silvia Municipal Tax Statute, Cauca, as established by Agreement No. 051 of December 2021, which requires discounts for stamps in signed contracts. In particular, the collection of stamps for the Welfare of the Elderly and the Stamp Culture Pro, which created an impact on the resources allocated to the Senior Living Centers and other welfare programs in the municipality.
These obligations are regulated in Law 1276 of 2009, Law 397 of 1997 and its modifications, which require compulsory collection in public procurement. Its non-compliance not only affected municipal finances, but also the local administration’s ability to implement public policies for the benefit of older adults and cultural promotion in Silvia, Cauca. Furthermore, it was noted failure to update the contracting manual and deficiencies in Emsilvia ESP’s contractual support.
The General Manager of Cauca will continue his surveillance and fiscal management work, guaranteeing that the necessary corrective actions are taken to protect public resources and promote efficient management in the department’s entities.
