The Ministry of Land, Infrastructure and Transport will enforce the ‘Revised Private Rental Housing Special Act and the Housing and Urban Fund Act’ starting from the 29th of this month. As part of these new regulations, a list of malicious landlords who frequently fail to return tenants’ deposits will be revealed within the year.

Tenants will have the opportunity to check and filter the list of malicious landlords when signing a lease contract through a secure lease application (app).

On the 28th, the Ministry of Land, Infrastructure and Transport announced that the amended Special Act on Private Rented Houses and the Housing and Urban Fund Act, which includes the legal basis for disclosing the list of malicious landlords, will come into force from the 29th. This is an important step towards protecting the rights of tenants.

The list of disclosures will include landlords who have been involved in two or more cases of indemnity debts claimed by the Housing and Urban Guarantee Corporation (HUG) within the last three years. The amount claimed must be more than 200 million won. Additionally, landlords with more than 100 million won in unreturned deposits, even after their rental business registration has been cancelled due to failure to return the deposit on time, will also be published.

However, the list of malicious landlords will not be published immediately after the enforcement of the law. The Ministry of Land, Infrastructure and Transport explained that this is to allow landlords who were unable to return deposits due to economic difficulties, rather than intentional wrongdoing, to explain their circumstances and avoid unnecessary losses. The Landlord Information Disclosure Discussion Committee will take approximately two to three months to make a final decision on whether the information should be disclosed.

If the Information Disclosure Committee decides to make the list public based on the landlords’ explanations, the names will be published on the Ministry of Land, Infrastructure and Transport and HUG websites, as well as the Safe app Charter.

It is expected that the list will be made available as early as this year.

In addition to the disclosure of the list of malicious landlords, the revised Special Act on Private Rental Housing also includes provisions to crack down on tax evasion by rental business operators. Rental business operators who violate national taxes exceeding 200 million won and local taxes exceeding 10 million won may be refused or have their registration cancelled by the city, county or area authorities.

Furthermore, a tax payment certificate has been added to the required documents when applying for rental business registration. This allows applicants to check whether they have any outstanding tax arrears before registration.

To prevent foreigners from misusing their residence status to register as rental business operators, the revised act specifies that only individuals with immigration, Korean foreigner, permanent residence, and marriage immigration visas are eligible for registration.

He also added that if the Information Disclosure Committee decides whether to make the list public based on the explanation, the names will be made public on the Ministry of Land, Infrastructure and Transport and HUG websites and the Safe app Charter.

If it falls under a reason for exemption from disclosure (eg the death of a lessee), it is exempt from disclosure. In addition, if an exception occurs after the list is published, the public information will be deleted.

It seems that it will be possible to reveal this list as early as this year.
