Recent legislative ⁢changes are shifting control over parking space requirements for new housing developments from the national level to local governments.the amendments, enacted through‍ the Act of July 25, 2025, amending the Act on social forms of housing development⁤ and some othre ⁢acts, ‍aim to provide municipalities⁣ with greater flexibility to⁤ adapt parking regulations to their specific needs and local conditions. The changes officially take effect on August 21,2025.

Why the Change? Addressing Local Needs and Promoting Enduring Development

The impetus for these changes stemmed from requests made by both investors and local governments. As outlined in the bill’s⁣ justification, the previous rigid national standards hindered municipalities’ ability to tailor parking requirements to factors like investment ‌area location, public transport availability, and existing bicycle infrastructure ‌- all elements detailed ⁣in local‌ spatial development ⁣plans. This ⁢inflexibility was ‌also identified as a barrier to the development ⁣of municipal‌ and social housing projects.

The new regulations align ⁤with ‍broader municipal efforts to encourage pedestrian and bicycle traffic, especially in urban⁤ centers. By granting local authorities more autonomy, the⁤ changes⁤ allow for parking policies that support sustainable transportation options and reduce reliance ‌on private vehicles.

According to Tomasz Lewandowski,⁣ Deputy Minister of Development and Technology,⁤ the Ministry actively “listened” to the concerns of local government officials when formulating these ⁤amendments, demonstrating a commitment to collaborative policymaking.

What Does This Mean for Developers and Municipalities?

The core change involves the ‌abolition⁣ of the nationally mandated minimum ratio of parking spaces for housing investments. ⁤Rather, local councils will have the exclusive‍ authority to determine the appropriate number of⁢ parking spaces required for new developments through local urban standards.

While the national‍ minimums are removed, the location resolutions adopted on the basis of a housing specialty ‌will still adhere to‍ Article 8, Paragraph 1, Point 8, of the relevant act. Furthermore, Article 19, Paragraph ⁤3 of the Housing Specifications will continue to authorize commune ‌councils to establish parking space requirements for housing ‍investments within their local⁣ urban standards, mirroring the regulations in place before ‍the Act of January 26, 2023, which aimed to eliminate unnecessary administrative and legal barriers.

This shift empowers ⁣municipalities to‍ create parking‌ policies that are responsive to their unique circumstances, possibly leading ⁤to more efficient land use, reduced congestion, ⁣and increased investment in ‌alternative transportation infrastructure. Developers will⁢ need‌ to engage with local authorities early⁣ in the planning process to understand ‍and comply with the new, locally determined⁤ parking requirements.

Effective Date and Legal Basis

The changes to parking space regulations ⁣come into effect on august 21, 2025, fourteen days⁢ after⁤ the announcement of the Act of ⁤July ⁣25, 2025, amending the Act⁤ on social forms of housing development and ⁢some other acts,⁣ which⁤ was‍ signed into law on August⁤ 5, 2025.

Legal‌ Basis:

Act of 5 July‌ 2018 on facilitations in the readiness and implementation of housing investments and ⁤accompanying⁣ investments (Journal of⁢ Laws of 2024, item 195, ‌as ⁣amended)
Act ‌of July⁣ 25, 2025‍ amending the Act on ⁢social forms of residential development and‍ some other⁤ acts (Journal of Laws of 2025, item 1077) ‌- signed on August 5, ⁢2025.
