Parking Space Regulations Relaxed: Local Governments Gain Control

Recent legislative changes are shifting control over parking space requirements for new housing developments from the national level to local governments.the amendments, enacted through the Act of July 25, 2025, amending the Act on social forms of housing development and some othre acts, aim to provide municipalities with greater flexibility to adapt parking regulations to their specific needs and local conditions. The changes officially take effect on August 21,2025.
Why the Change? Addressing Local Needs and Promoting Enduring Development
The impetus for these changes stemmed from requests made by both investors and local governments. As outlined in the bill’s justification, the previous rigid national standards hindered municipalities’ ability to tailor parking requirements to factors like investment area location, public transport availability, and existing bicycle infrastructure - all elements detailed in local spatial development plans. This inflexibility was also identified as a barrier to the development of municipal and social housing projects.
The new regulations align with broader municipal efforts to encourage pedestrian and bicycle traffic,especially in urban centers. By granting local authorities more autonomy, the changes allow for parking policies that support sustainable transportation options and reduce reliance on private vehicles.
According to Tomasz Lewandowski, Deputy Minister of Development and Technology, the Ministry actively “listened” to the concerns of local government officials when formulating these amendments, demonstrating a commitment to collaborative policymaking.
What Does This Mean for Developers and Municipalities?
The core change involves the abolition of the nationally mandated minimum ratio of parking spaces for housing investments. Rather, local councils will have the exclusive authority to determine the appropriate number of parking spaces required for new developments through local urban standards.
While the national minimums are removed, the location resolutions adopted on the basis of a housing specialty will still adhere to Article 8, Paragraph 1, Point 8, of the relevant act. Furthermore, Article 19, Paragraph 3 of the Housing Specifications will continue to authorize commune councils to establish parking space requirements for housing investments within their local urban standards, mirroring the regulations in place before the Act of January 26, 2023, which aimed to eliminate unnecessary administrative and legal barriers.
This shift empowers municipalities to create parking policies that are responsive to their unique circumstances, possibly leading to more efficient land use, reduced congestion, and increased investment in alternative transportation infrastructure. Developers will need to engage with local authorities early in the planning process to understand and comply with the new,locally determined parking requirements.
Effective Date and Legal Basis
The changes to parking space regulations come into effect on august 21, 2025, fourteen days after the announcement of the Act of July 25, 2025, amending the Act on social forms of housing development and some other acts, which was signed into law on August 5, 2025.
