Public Institute Researcher Sentenced for Sexual Assault – Appeal Claims ‘Loss of Control After Drinking’ [JTBC Coverage]

There was an incident where a researcher at a public institute of the Ministry of Oceans and Fisheries sexually assaulted a colleague while she was on a business trip. The offender was sentenced to six years in prison in the first trial, but appealed, saying: “I lost control after drinking.”


On the 6th, JTBC reported that A, a researcher at the National Institute of Marine Biological Resources, broke into the hotel room of B, a researcher, and sexually assaulted her during a business trip in July of last year.

According to media reports, at the time, researchers from the institute went on a business trip to Tongyeong, Gyeongsangnam-do, to investigate the diversity of marine life. The day before returning, the researchers had dinner and drinks.

Mr B was out with colleagues and returned to his hotel room around 7.40pm drunk. Mr. B, who fell asleep in bed, said he woke up to the sound of someone else about 2 hours later. The other person was Mr A, a man in his forties who worked as a research officer with whom he had no particular personal contact.

Mr. B recalled that moment, saying: “When I opened my eyes, I was already lying naked and the person was in front of me. I pushed him with my foot and said, ‘Go away,’ and the person said : ‘I understand, I understand.'” It was reported that Mr. A continued to commit the crime despite Mr. B’s resistance.

After checking the hotel’s CCTV footage, it was confirmed that Mr. A lied to the hotel manager and entered Mr. B’s room. Mr. A asked the manager: “Our employee is went to the accommodation with something important for work, but we can’t contact him, so please open the room door.”


Accordingly, the manager opened the door with a spare key and, while waiting outside, Mr A took the key from Mr B’s room and left, leaving behind a restaurant business card. Later, when the manager returned, Mr. A secretly entered Mr. B’s room and committed the crime.

It was reported that the National Marine Biological Resources Institute fired Mr A in November last year, four months after the accident.

Mr A was sentenced to six years in prison in his first trial last January. The court said: “The victim committed adultery in a planned way, taking advantage of a situation which was difficult for her to deal with. As she did not use contraceptives, the risk of additional harm was high,” but added: “The fact that she having admitted the crime and having no criminal record is an advantageous criterion”, explained the motivation for the sentence.

Mr A appealed, saying the punishment was harsh. Mr. A’s side claimed that the crime was accidental, saying: “During the investigation, he denied the crime, but admitted everything in the first trial. He drank alcohol and lost control while submerging himself in sea water for four days in the height of summer”. to collect marine life.”

The case is currently awaiting a second trial. Mr. B asks for severe punishment without reaching an agreement with Mr. A.
