Rationales for accepting Hossam Al-Mandouh’s appeal regarding his right to be the trustee of the Zamalek Club Fund and canceling his exclusion

The Supreme Administrative Court issued a ruling recently in which it concluded that the election and victory of Hossam El-Mandouh to the position of Treasurer of Zamalek was valid.

In its findings, the court said that the Interim Committee for Managing the Affairs of the Zamalek Sports Club had announced the invitation of the club’s regular general assembly to convene on Friday, 10/20/2023, to elect a new board of directors for the club for the 2023/2027 electoral cycle, and the door to candidacy for these elections was opened, so it was submitted. He submitted his nomination papers for the position of Treasurer of the Club’s Board of Directors, and his nomination papers were accepted and included in the final list of candidates.

The court added that the appellant is a member of the House of Representatives in its current session, and that the Constitution and the legislator have required that a member of the House of Representatives devote himself to membership duties throughout its term if he is a worker in the state, in the public sector, in the public business sector, or in companies that the state has the right to manage or own. (50%) or more of its shares, regardless of the bylaws to which it is subject.

She explained that, since the delegate is not one of those working in these bodies, which are mentioned exclusively in Articles No. (31) and (354) mentioned above, then his membership in the House of Representatives does not prevent him from membership in the Board of Directors of the Zamalek Club, which makes it clear that With him is the decision of the temporary committee entrusted with managing the affairs of the Zamalek Club, including accepting the appellant’s nomination papers and including him in the final list of candidates for the seat of club treasurer, which was in accordance with the provisions of the constitution and the law.

Today, Tuesday, the Supreme Administrative Court of the State Council ruled in the appeal filed by Hossam El-Din Al-Mandoua Al-Khawaja, the Zamalek Club candidate, against the ruling of the Administrative Judicial Court of the State Council, which issued the exclusion of Al-Mandoua from running for the seat of Treasurer from the final electoral lists for the Zamalek Club elections held on… 10/20/2023, in the lawsuit bearing No. 77/78723, Minister of Youth Ashraf Sobhi in his capacity and others, and the court ruled to accept the appeal in form and in substance to cancel the contested ruling and order the court again to reject the original lawsuit.

In the appeal filed before the Supreme Administrative Court, Al-Mandouh demanded a stay of implementation of the ruling issued by the Administrative Judicial Court excluding him from the Zamalek Club elections announced to be held on October 20, as well as the continuation of his candidacy for the position of fund secretariat.
