The Audios case has opened a real “Pandora’s Box” inside the Supreme Court, revealing a series of episodes that would account for periods of influence peddling and other irregularities in the Judiciary. This has led to the publication of a series of constitutional charges against those involved, including María Teresa Letelier, Ángela Vivanco, and Jean Pierre Matus, along with critics such as Mario Carroza and Sergio Muñoz.
Mario Carroza: A History of Breaking Integrity
The first warning voice about the situation of Judge Mario Carroza, responsible for emblematic cases such as the Death Caravan, the Quemados Case, and the deaths of Alberto Bachelet, Pablo Neruda, and Eduardo Frei Montalva, arose when deputy Camila Flores (RN) announced that her party’s caucus would prepare a libel against him.
This came after conversations he had with former judge Juan Antonio Poblete, of the Copiapó Court of Appeals, were revealed, in which they discussed “walking in” to notary appointments.
“If we are going to constitutionally charge the ministers of the Supreme Court for illegality, for lack of integrity, for moral or moral reprehensibility, everyone who has committed these same acts must be. Mario Carroza’s Response
Given this scenario, Mario Carroza appeared unfazed and stated that bringing charges against him was part of the powers of the Legislative Branch. “Congress, in this case the deputies, have every right, because they are using their oversight powers and it seems to me very good that they are exercising them.”
When asked if he is afraid of being banned, Carroza emphasized “no. On the contrary, we are public authorities who must be subject to public scrutiny.”
The Leak of Information that Complicates Sergio Muñoz
Another magistrate who has been in the eye of the storm in recent days is Sergio Muñoz Gajardo, who at the time was responsible for the Tucapel Jiménez Case, the investigation against Claudio Spiniak, and the Riggs Bank case.
Muñoz, who is part of the Third Chamber of the Supreme Court and questioned – like Mario Carroza and until a few days ago Ángela Vivanco – was denounced by Inmobiliaria Fundamenta for leaking information to his daughter, the guarantee judge Graciela Muñoz.
In the presentation made by the lawyer Marco Antonio Fuentes, the judge of the highest court is accused of presenting “sensitive and detailed information” to his daughter regarding the process of returning bonds for the promises of the sale of two flats.
“Graciela Muñoz points out to Valentina Riquelme (Inmobiliaria Fundamenta executive) that This process can take years and I don’t think I want, or can, wait that long and I tell you this with knowledge, not because I’m a lawyer, but because my father is the one who sees this whole matter, since then. he participates in the Supreme Court.”, states part of the complaint released by The Mercury.
In this line, The warrant judge told the executive that Sergio Muñoz recommended that she ”move the money for the project”. This, although a series of appeals presented by the real estate company in the Third Chamber of the Supreme Court, under the chairmanship of Muñoz, was pending.
For Fuentes, this “leads to determining that the privileged information that Minister Sergio Muñoz had was used to try to ensure that his daughter, Graciela Muñoz, obtained an economic benefit with the money invested in the different Inmobiliaria Fundamenta projects.”
