Supreme Court Overturns Sentence in University Hospital Death Certificate Falsification Case

The Supreme Court has overturned the sentence of doctors of a university hospital found guilty in the first and second trials on charges of falsifying the death certificate of a newborn baby who died during a hospital visit, finding them not guilty.

The First Division of the Supreme Court fined two doctors at a university hospital 5 million won and 3 million won respectively for allegedly filing the death certificate of a newborn baby who died after a needle lacerated an artery. during a bone marrow sampling test in 2015, indicating that the child died due to an illness. The original verdict was quashed and remanded to the Ulsan District Court.

The Supreme Court stated: “The cause of death listed on the death certificate does not correspond to the actual cause of death, but based on the time the death certificate was made, it has not been shown that there was an intent to falsify.”

Previously, the court of first instance had sentenced him to a fine, stating: “Although the doctors did not know that he had died from a ruptured artery, we believe that they were fully aware that the victim could not be considered dead due to of a chronic disease”. ”, and the second district court also found him guilty.
