The New Taipei District Prosecutor’s Office and the police found out that Huang Boquan is the person in charge of Shengzhi Trading Co., Ltd. Since 2017, he has contacted a Chinese pirate businessman who calls himself “Mr. Xu” to establish Taiwan Anbo Company, and “Mr. Xu” and others have provided information. After passing the test, the qualified label and product inspection mark will be provided to “Mr. Xu” and others to mark on the Anbo box.

Subsequently, they were imported through agents authorized by Huang Boquan and resold to downstream dealers or retailers for profit. Huang Boquan collected authorization fees from the agents and also reported Taiwanese companies that sold Ambo boxes without Huang’s authorization. And asked the platform to be removed from the shelves to safeguard its own market interests.

The prosecutor also found that in 2020, Huang Boquan asked his friends to apply for OTT membership accounts such as “Four Seasons Online”, “Elda TV” and “LiTV” and provided them to “Mr. Xu”, who then rented them from China. After the computer server obtains the member’s broadcast certificate, it captures and decodes the signal provided by the OTT operator for the member to watch the channel, converts it into a network packet form and reproduces it, uploads it to the cloud server, and then provides the program to the exclusive APP of Ambo Box Consumer viewing infringes the copyright property rights of channel operators.

The Collegiate Court of the New Taipei District Court held that protecting the rights and interests of works has become a national consensus and a national movement. Huang Boquan knew that the content provided by Anbo Box was unauthorized, but he still pursued personal gain and did not hesitate to participate in “Mr. Xu” and criminal groups, forming an upstream and downstream industry chain of infringement. , infringed upon numerous copyrights over the past four years, and affected Taiwan’s international reputation for protecting intellectual property rights and the development of related industries.

The collegial court considered that Huang Boquan denied the crime, refused to cooperate in unlocking the phone password, and did not reconcile with the victim. He was a young man with high education and business acumen, but he was willing to serve as the person in charge of Taiwan for “Mr. Xu” and the criminal group. , is a criminal leader-level member, and when participating, he could foresee that he would bear all legal responsibilities and compensation obligations, and there is nothing worthy of sympathy.

The collegial panel pointed out that downstream manufacturers sell 150 to 200 Ambo boxes every month, and after checking the seller information on the shopping website, more than 3,200 Ambo boxes were sold. Huang Bing stated that he made an annual profit of 1 million to 2 million yuan, etc., and the number of copyright infringements was numerous. This also affected consumers’ willingness to subscribe to cable TV. Therefore, Huang Boquan was sentenced to 4 years in prison for violating the copyright law of “infringing the copyright property rights of others by copying with common intention to sell”; Taiwan Anbo Company was fined NT$1 million.
