The SCJN stops appointments to replace the governor of Nuevo León

The Supreme Court of Justice of the Nation (SCJN) suspended the appointments that were made in Nuevo León to replace Governor Samuel García, so that he temporarily separates from office as of next December 2 and seeks the presidential candidacy for the Citizen Movement (MC ).

Minister Javier Laynez suspended the appointment as interim governor of José Arturo Salinas, president of the Superior Court of Local Justice (TSJ) and of the secretary of government, Javier Luis Navarro as office manager that the state president made.

It should be noted that as a result of the license requested and granted to the governor, two constitutional controversies were filed before the Court.

The first, by the Executive Branch of the State of Nuevo León, who demanded the invalidity of the appointment of the Interim Governor that fell to the president of the Superior Court of Justice of that federal entity.

The second, by the State Congress, which demanded the invalidity of an agreement of the Governor in which he designated the Secretary General of the government as in charge of the office of the local Executive Branch.

Both controversies have been admitted by the Court and regarding the requested suspension, it was determined to grant it with respect to the following acts: The designation of the President of the Superior Court of Justice of the State as interim Governor and the respective taking of protest.

As well as the agreement issued by the Constitutional Governor regarding the appointment of the person in charge of the office during his leave.

The above, in order not to jeopardize the principle of separation of powers provided for in articles 49 and 116 of the Federal Constitution.

Besides, refused to grant the suspension in the sense that Congress would refrain from carrying out any appointment; That is, the powers of the local Legislative Branch to appoint the interim Governor of said entity remain safe..
