The Social Security Institution includes a deceased worker retroactively according to the provisions of its law

The General Organization for Social Security explained that the Security Affairs Committee made its decision to include the deceased worker, “Hassan Mustafa Hassan Al-Yamani,” under the provisions of its law and accepted the grievance submitted by the heirs of the late Hassan regarding the cancellation of its previous decision not to include him, which will qualify his heirs to proceed with the procedures for obtaining the death retirement pension. Arising from a work injury.

The Corporation stated in a press release that the worker who was working in electrical installations died in a work accident with one of the contracting companies contracting with one of the commercial malls in Amman, and he was not covered by the warranty at this facility. His heirs filed a complaint with the Corporation and the facility was visited by the Branch Management Inspection Directorate. North Amman Guarantee, where it was claimed by the company that he does not work for it, but rather for a subcontractor, which is why the initial decision was issued by the corporation not to include him in the provisions of the law because the subcontractor does not have a commercial record and is not covered by the guarantee.

The Corporation indicated that the judicial investigations showed that the insured was a worker for the contracting company and not for the subcontractor as was claimed. It became clear that there was an agreement between the supposed subcontractor and the facility for the purposes of not including the aforementioned worker and not holding the employer responsible. As a result of these investigations, Accepting the grievance from the heirs of the deceased worker and considering him as a worker in the facility, which will result in his heirs being entitled to a death retirement pension resulting from a work injury. The decision will be transferred after informing the heirs to the relevant security branch to complete the inclusion procedures in preparation for proceeding with the procedures for allocating the salary according to the rules.

The Foundation confirmed that evading any worker’s inclusion in insurance, or not including him on the basis of his real wage and for the entire period of his work, which is called the phenomenon of insurance evasion, has serious effects on society and individuals, as this phenomenon negatively affects social and economic security. Because it prevents the state from achieving its economic and social goals in terms of human protection, and leads to a violation of the principle of justice in rights, and increases pockets of poverty in society. As a result of people leaving the labor market without receiving retirement salaries, indicating that comprehensive social security is what the institution seeks, and that it will confront all cases of evasion of inclusion by the force of the law and workers’ awareness.

The Foundation called on everyone who joins the labor market, whether Jordanian or non-Jordanian, in any of the economic sectors, to verify their coverage of social security, stressing that the right to security is an inherent human, legal, and labor right, adding that it receives complaints on a daily basis from workers in various economic sectors related to the establishments’ non-compliance. Which they work for includes them in the guarantee, and it verifies this matter through its inspection department and the inspection directorates in its branches and includes the workers if they meet the conditions of inclusion.

The institution confirmed that the insurance umbrella is the broadest umbrella of social protection in the Kingdom and that it is a safe haven for the workforce, indicating that the insurance institution opens its arms to everyone as an institution for the worker and the citizen and that all its channels are available to receive any inquiries or complaints related to the lack of inclusion of workers under its umbrella.
