Victor Malavet, a former employee of the Youth Detention Services Unit in Concord, will not face a third trial in the case alleging sexual assault of a teenage girl over 25 years ago, as state officials have declined to pursue further prosecution.
The decision comes after two prior trials resulted in a mistrial in 2024 due to a deadlocked jury and subsequent legal proceedings that did not yield a conviction. Malavet, 62, of Guilford, had pleaded not guilty to 12 counts of aggravated felonious sexual assault related to alleged incidents occurring in 2001 and 2002 at the Concord facility, where he was accused of physically, sexually, mentally and emotionally abusing a 15-year-old girl.
The victim, Natasha Monsell, has spoken publicly about her experience and previously reached a $4.5 million settlement with the state. She stated during the most recent trial that she trusted Malavet but that he took advantage of her and raped her. The defense has maintained that the alleged assaults did not occur.
The case is part of a broader pattern of legal actions involving former staff at New Hampshire’s youth detention facilities, including the Sununu Youth Services Center in Manchester, where multiple individuals have faced charges related to historical abuse allegations. However, officials confirmed that no further criminal proceedings will be pursued against Malavet at this time.
