Britain has dropped controversial proposals to remove the historic right to trial by jury for defendants facing less serious criminal charges, following widespread opposition from lawyers and politicians, reuters.com reported on October 4. Prime Minister Andy Burnham’s government abandoned the policy shift as the criminal justice system struggles with a severe capacity crisis that has forced the early release of hundreds of prisoners.

Ministry of Justice Abandons Three-Year Prison Threshold

The Ministry of Justice confirmed that plans to curb jury trials for criminal offenses where a potential jail sentence was expected to be under three years would not move forward. The reversal marks a direct retreat from a strategy introduced under former Prime Minister Keir Starmer, whose justice secretary argued last year that curtailing jury trials would accelerate court proceedings.

Critics, however, maintained that years of government neglect and under-investment were the true drivers of court delays rather than the use of juries. England’s judiciary head also raised grave security concerns regarding judge-alone trials during the policy debate. Justice Secretary Alex Norris acknowledged the intense pushback, stating that he listened to the strength of feeling on proposals for increasing judge-alone trials in the Crown Court and changed course.

Legal Profession Welcomes Reversal While Warning of Magistrate Expansion

Legal representatives offered a mixed response to the government announcement, expressing relief over the retention of juries while criticizing simultaneous changes to lower courts. Criminal Bar Association chair Andrew Thomas thanked the administration for listening to evidence, though he cautioned that a severe threat to trial by jury remains.

Bar Council chair Kirsty Brimelow echoed those reservations, pointing out that expanding sentencing powers for magistrates—who try minor offenses without juries—could prove counterproductive while magistrates’ court backlogs continue to grow. Lawyers specifically objected to the removal of defendants’ rights to elect jury trials alongside those broader magistrate powers.

Crown Court Backlogs Leave Victims Waiting Years for Hearings

The policy reversal unfolds against a backdrop of delays across the legal system in England and Wales. Crown Court data showed the active backlog of cases awaiting jury trial reached nearly 81,000 at the end of June, roughly double the recorded total in 2020. Victims, defendants, and witnesses frequently wait years for their cases to reach a courtroom.

Despite dropping the three-year threshold changes, the Ministry of Justice stated it will proceed with separate plans allowing complex fraud trials to be heard by a judge alone. That approach has long been discussed to prevent jurors from sitting on trials lasting many months, even though a government-commissioned review rejected the concept earlier.
