Continuity of Childcare Services Amidst War
Despite the ongoing war in Ukraine, the childcare service of the “Municipal Nanny” continues to operate, providing essential support to families in need. Specialists from “Legal Adviser for UDPs” have outlined the key characteristics of this service.
Regulatory Framework
The provision of the “Municipal Nanny” service is regulated by Cabinet Decision No. 664 of 7 June 2024.
Eligibility Criteria
During martial law and three months after its end, the following individuals are entitled to compensation for the “Municipal Nanny” service:
- Citizens of Ukraine and foreigners/stateless persons who are the child’s parents or guardians;
- Legally living on the territory of Ukraine and taking care of a child under 3 years old;
- One of the parents or guardians is an IDP.
Requirements for IDPs
IDPs are not guaranteed an unconditional right to appointment and reimbursement of the cost of childcare services. Parents and guardians must meet at least one of the following requirements:
- Work for hire under the terms of an employment agreement (contract) or other conditions provided for by law;
- Provide work independently (as an individual entrepreneur);
- Carry out retraining or promotion;
- Have been registered unemployed for no more than six months;
- Participate in community service;
- Participate in activities necessary to ensure the defense of Ukraine, protect the security and interests of the state in connection with the armed aggression of the Russian Federation.
Requirements for the Municipal Nanny
The legislation also establishes requirements for the “Municipal Nanny” itself:
- Cannot be a first-degree relative;
- Must be a sole proprietor and provide care for no more than 3 children from the same or different families at the same time, or be a legal entity and provide care for no more than 6 children from the same or different families at the same time (with an additional obligation to ensure access for children to the shelter).
Important Considerations
For example, an older child is a first-degree relative of the applicant (his mother) and cannot be an urban nanny for a younger child, even if the family and the potential urban nanny meet other criteria.
