US Government to Begin Restoring $166 Billion in Recovered Funds

The United States government will begin refunding $127 billion of an estimated $166 billion in disputed tariffs collected from U.S. Businesses starting April 20, 2026.

This repayment process follows a February 2026 Supreme Court of the United States ruling which determined that tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unlawful.

The decision created a massive financial obligation for the government, affecting approximately 330,000 importers who paid duties that the court found lacked legal justification.

The CAPE Portal and Refund Mechanism

To manage the volume of claims, U.S. Customs and Border Protection (CBP) is developing a digital platform called the Consolidated Administration and Processing of Entries (CAPE) portal. This system allows companies to submit their refund claims online without the need to initiate individual lawsuits.

The government has established a four-stage system to process the repayments. The first step of this strategy requires companies to submit their formal refund requests through the CAPE portal.

In a court filing submitted to the United States Court of International Trade, CBP officials indicated that the CAPE platform was between 40% and 80% complete as of March 2026, with performance testing scheduled to follow.

Legal Mandates and Interest Payments

The implementation of the refund system comes after Judge Richard Eaton of the Court of International Trade ordered CBP to begin repaying importers. Judge Eaton ruled that the government must utilize its existing systems to issue payments, and specifically mandated that these refunds include interest.

The court order ensures that the repayment covers all affected importers, not only those who had already taken their cases to court.

Brandon Lord, a top official at CBP, stated in a filing that the total sum held in relation to these tariffs was estimated to be approximately $166bn.

Business and Market Impact

The prolonged period of tariff collection has created significant liquidity challenges for many American manufacturers and importers. Some cash-starved companies have reportedly begun using their pending refund claims as collateral to secure loans.

The scale of the operation makes this one of the largest trade refund efforts in the history of the United States.
