IBK Industrial Bank of Korea (IBK), a women’s professional volleyball team, has decided to terminate a player contract with setter Jo Song-hwa, who has caused controversy over trespassing.

IBK announced on the 13th that it would terminate the player contract for Jo Songhwa. As a result, Jo Song-hwa became a free agent (FA). Termination of a player contract literally means that the contract between the club and the player has ended. In case of termination of the player contract, the player’s written consent is not required.

On the 26th of last month, IBK requested the KOVO Reward and Punishment Committee to review Cho Songhwa on the grounds of ‘violation of the player contract’.

On the 10th, the KOVO Reward and Punishment Committee called Song-Hwa Jo and the club officials to find out the facts, but decided to withhold the disciplinary action because the opinions of the two sides were sharply different.

Industrial Bank of Korea emphasized, “The content of the contention that Song-hwa Jo made in relation to the reasons for disciplinary action by the reward and punishment committee is very different from the facts that the club is aware of.”

Songhwa Cho protested at the reward and punishment committee that the reason she left the team twice last month was not for trespassing, but for health reasons. He added that he would not admit trespassing and hope to play as an active player at the same time.

On the other hand, the club made it clear that it could not go with Songhwa, apart from the decision to suspend the reward and punishment penalty.

IBK said, “Regardless of the decision to suspend disciplinary action by the Reward and Punishment Committee, we have determined that Song-hwa Jo’s behavior constitutes a serious violation of the player contract. said.

Meanwhile, as IBK announced the termination of the contract with Jo Song-hwa, the possibility of a legal battle with the players over the remaining salary payment increased.

According to Article 23, Termination of Contract, Paragraph 4 of the Professional Volleyball Standard Contract, if this contract is canceled due to reasons attributable to the club, the entire remaining annual salary must be paid.

Conversely, if the contract is terminated for reasons attributable to the player, the remaining annual salary cannot be received in full. The club must pay 1/365 of the annual salary multiplied by the number of days from the day following the final salary payment date to the contract termination date.

Before the 2020-21 season, Jo Song-hwa signed an FA contract with IBK for a total salary of 270 million won, including an annual salary of 250 million won and an option of 20 million won. In the same season, the annual salary was 250 million won and the option was 20 million won.

According to IBK, the club and players are expected to have a legal battle over the payment of the remaining salaries for the 2021-22 season.
