Appeal Court Upholds Fine for Woman Who Assaulted Swimmer Over Showering Incident

Appeal Court Sentences Woman to Fine for Assaulting Man at Swimming Pool

The Criminal Division of Chuncheon District Court 1, presided over by Judge Shim Hyeon-geun, has announced its decision to sentence a 68-year-old woman, known as Mr. A, to a fine of 500,000 won for assault charges. The incident took place in July last year at a swimming pool in Wonju, Gangwon-do, where Mr. A physically confronted a man in his 40s, Mr. B, for not showering properly before entering the pool. Mr. A pushed Mr. B’s shoulder and pulled and tore his swimming cap and swimsuit in the shower room, leading to the assault charges.

Formal Trial Request Denied

Despite Mr. A’s objection to the summary fines order and request for a formal trial, the court upheld the decision and sentenced her to the same fine as the original case. Mr. A claimed at the appeal trial that she had never assaulted the victim, but the court rejected her claim based on the victim’s specific statement and other evidence.

Court’s Ruling

The court justified its decision by stating, “Given that the eyewitness saw the attack at the time and that the shoulder of the victim’s swimsuit was torn in the photo taken by the police officer who was dispatched, we can admit that he assaulted the victim.”

The appeal court sentenced a woman in her 60s to a fine for assaulting another person for not showering properly before entering the swimming pool.
