Commodity Futures Trading Commission would allow U.S. crypto exchanges to opt into a federal regulatory framework. This alternative replaces the current reliance on a patchwork of state money-transmitter licenses. The agency structured the proposal by utilizing a specific authority it holds to oversee margined or leveraged spot assets. While the Commodity Futures Trading Commission has long sought broad authority to regulate spot cryptocurrency markets operating in a regulatory grey area, only Congress possesses the power to grant that ultimate purview.
The announcement follows the failure of Congress to advance a major crypto bill named the Clarity Act. That legislation would have established new rules for the $2 trillion cryptocurrency market and placed the industry on a firmer legal footing by giving the Commodity Futures Trading Commission explicit spot-market authority. Because of that legislative impasse, the responsibility has shifted to the crypto-friendly regulators under U.S. President Donald Trump, specifically the Securities and Exchange Commission and the Commodity Futures Trading Commission.
New Crypto Asset Market Trading Venue Category Established
Under the proposal, the regulator would establish a distinct category of regulated trading venues known as a crypto asset market.
This category applies directly to exchanges that offer leveraged or margined trading to retail customers. Platforms operating in this tier would face mandatory requirements, including specific anti-market-manipulation controls and a formal proof of reserves
obligation.
The Commodity Futures Trading Commission also proposes that registered futures commission merchants intermediate customer trades on these new exchanges. The agency stopped short of stipulating specific leverage limits. However, any exchange offering a leveraged transaction must clear that product directly with Commodity Futures Trading Commission staff.
Regulatory Vulnerabilities Persist Without Congressional Legislation
Industry analysts point out that regulatory actions taken without accompanying legislation remain vulnerable to shifting political climates and subsequent court challenges. These vulnerabilities create lingering hazards for the cryptocurrency sector even as regulators attempt to provide clarity.
