El Mencho: Hearing of the trial against his wife is postponed

A federal judge postponed the oral trial hearing of Rosalinda González Valencia, wife of the leader of the New Generation Cartel (CNG), Nemesio Oseguera Cervantes, alias “El Mencho”, for the money laundering case against him.

And a period of five days, counting from its notification, was granted to the defense of the accused and the Attorney General of the Republic (FGR) to organize and notify the order in which they intend to present their testimonial and documentary evidence.

The above, because during Thursday’s proceedings, the prosecutors announced before the trial judge that they were going to present 40 witnesses, including experts, police agents and public ministries, but 12 of them did not go to the Federal Criminal Justice Center in the State of Morelos, with residence in Xochitepec, and have not yet been located by the Federal Public Ministry.

Given this, the judge granted the FGR the postponement of the hearing to have all the witnesses offered as evidence, which was described as illegal by González Valencia’s defense, because, he stated, “we are in a trial stage, since We finished the investigation and intermediate stages, so if the Public Ministry does not bring its witnesses as evidence that was admitted, at this moment they should be discarded, they have no other opportunity”; what was denied him.

For this reason, the defense of alias “La Jefa” He accused the Attorney General’s Office of trying to delay the process to gain time and organize the case.

In an agreement dated yesterday, the administrator of the Federal Criminal Justice Center in the State of Morelos, with residence in Xochitepec, Clarisa Acevedo Adame, determined that the defense of the accused and the FGR They have five days to group the witnesses they will present for each day, taking into consideration that only a minimum of four and a maximum of five pieces of evidence will be allowed for each procedure.

If a witness or expert does not appear, the trial hearing may be exceptionally suspended for a maximum period of ten calendar days; otherwise, it will be considered interrupted and must be restarted before a different Trial Court and the action will be null.

If the requirements are not met, the District Judge, Guillermina Matías Garduño, who will serve as the Trial Court, could impose on the parties a fine of 20 units of measurement and updating.
