OpenAI has requested that the attorneys general of California and Delaware investigate Elon Musk and his associates for alleged improper and anti-competitive behavior.

In a letter sent on April 6, 2026, OpenAI strategy chief Jason Kwon alleged that Musk has engaged in a series of attacks designed to undermine the company. The letter specifically claims that Musk has been coordinating his efforts with Meta CEO Mark Zuckerberg to achieve these goals.

The request for a government investigation comes as OpenAI seeks to restructure as a for-profit company, a move that Musk has actively attempted to block. According to Kwon, Musk has repeatedly attempted – and failed – to wrest control of the nonprofit for his personal gain in an effort to dominate the future of artificial intelligence.

The accusations arrive shortly before a high-profile legal battle between Musk and OpenAI is set to proceed. Jury selection for a trial involving Musk, OpenAI, and Microsoft Corp. Is scheduled to begin on April 27, 2026, in the Northern District of California.

The current friction is rooted in a long history between Musk and the AI lab. Musk and OpenAI CEO Sam Altman co-founded the organization in 2015 as a nonprofit. However, Musk left the company in 2018 after an unsuccessful attempt to convince executives to merge OpenAI with Tesla.

Following his departure, Musk launched his own competing AI venture, xAI. In 2024, he filed a lawsuit against OpenAI, claiming he was assiduously manipulated and deceived as the organization moved toward a for-profit structure.

Impact on Artificial General Intelligence

OpenAI argues that Musk’s actions extend beyond personal or corporate disputes and could have broader industry implications. Kwon stated in the letter that Musk’s behavior could inhibit OpenAI’s progress toward achieving artificial general intelligence, or AGI.

AGI is defined as an AI system with a broad range of capabilities that rivals or exceeds human intelligence. OpenAI suggests that the alleged anti-competitive behavior threatens the development and deployment of this technology.

The company’s strategy chief maintains that the attempts to seize control of the nonprofit were motivated by a desire to dictate the trajectory of AI development for personal benefit rather than the original nonprofit mission.
